Welcome to nip stories.

These Terms of Service set out the terms that apply when you visit, browse, shop from, or otherwise use our website, online store, products, content, features, tools and services.

In these Terms, “we”, “us”, “our” and “nip stories” mean RS STORIES LTD t/a nip stories, a company registered in New Zealand. “You” means the person accessing or using our website or purchasing our products.

By using our website or placing an order with us, you agree to these Terms, our Privacy Policy and any other policies referred to in these Terms. If you do not agree, please do not use our website or place an order.

1. Consumer rights

Nothing in these Terms limits, excludes or modifies any rights or remedies you may have under laws that cannot lawfully be limited, excluded or modified.

This includes rights you may have under the Consumer Guarantees Act 1993 and Fair Trading Act 1986 in New Zealand, the Australian Consumer Law where it applies, and any other mandatory consumer protection laws that apply in your location.

If there is any inconsistency between these Terms and your non-excludable legal rights, your legal rights will prevail.

2. About our website and store

Our website and online store are operated by RS STORIES LTD t/a nip stories. Our store is powered by Shopify, which helps us provide our online shopping experience, checkout, payments and related services.

Any purchase you make through our store is made directly with RS STORIES LTD t/a nip stories, not Shopify. Shopify is not responsible for the products you purchase from us, any order issues, delivery issues, product concerns, refunds or other matters relating to your purchase from us.

3. Eligibility and account information

You may use our website and purchase from us if you are legally able to enter into a binding contract, or if you have the consent of a parent or guardian.

When you place an order or create an account, you agree to provide information that is accurate, current and complete. This may include your name, email address, billing address, shipping address, phone number and payment details.

You are responsible for keeping your account login details secure and for all activity under your account. You must not transfer, sell, assign or allow another person to use your account without our consent.

4. Our products

We make reasonable efforts to describe and display our products accurately, including product features, sizes, colours, materials, pricing and availability.

However, product colours, appearance and scale may vary depending on your screen, device settings, lighting, photography and how the product is worn or used. Product fit and performance may also vary depending on your body, skin, outfit, activity, climate and how closely you follow the product instructions.

Our products are not medical products. If you have sensitive skin, allergies, a known skin condition, or any concern about whether a product is suitable for you, please seek advice before use. Do not use adhesive or skin-contact products on broken, irritated, sunburnt, inflamed or damaged skin. Stop using the product if you experience discomfort, irritation, redness, itching or any other reaction.

You agree to read and follow all product instructions, care instructions, warnings and guidance provided on our website, packaging or other materials. Incorrect use, storage, cleaning or care may affect product performance and lifespan.

We may update, change, discontinue or limit the availability of products at any time. We may also limit quantities available for purchase, including where we reasonably believe an order may be for resale, misuse or an unlawful purpose.

5. Orders and acceptance

When you place an order, you are making an offer to purchase the products in your cart at the checkout price shown.

Your order is accepted when we confirm acceptance, process payment and/or dispatch the order. We may accept or decline an order at our discretion, including where:

• a product is unavailable;

• there is an error in the product description, price, promotion, shipping charge or availability;

• your payment is declined or appears unauthorised;

• we cannot deliver to the address provided;

• we reasonably suspect fraud, misuse, resale or unlawful activity; or

• we are unable to fulfil the order for reasons outside our reasonable control.

If we decline or cancel an order after payment has been taken, we will refund the amount paid for the cancelled items, unless we are legally entitled to do otherwise.

Please check your order details carefully before submitting your order. We may not be able to change or cancel an order after it has been placed, especially if it has already been processed, packed or dispatched.

Unless we agree otherwise in writing, products purchased from our website are for personal or household use and are not for commercial resale.

6. Prices, currency, taxes and promotions

Prices are shown in the currency displayed on our website or at checkout. The final price for your order will be shown at checkout before you submit payment.

For New Zealand customers, prices include GST where applicable unless stated otherwise.

For customers outside New Zealand, prices may not include customs duties, import taxes, brokerage fees, local taxes or other charges that may apply when your order enters your country. You are responsible for any such charges unless we expressly state otherwise at checkout.

Shipping charges and any applicable discounts or promotions will be shown or explained at checkout where applicable.

Prices, offers, discounts, bundles, gifts with purchase and promotions may change at any time. Promotions may be subject to separate terms, eligibility requirements, expiry dates, product exclusions, minimum spend requirements or country restrictions. If promotion terms conflict with these Terms, the promotion terms will apply to that promotion.

We may correct pricing, product, promotion, shipping, availability or other errors at any time. If an error affects an order you have placed, we may contact you to confirm whether you still wish to proceed at the corrected price or terms, or we may cancel the affected part of the order and refund you.

7. Payment and billing

You agree to provide current, complete and accurate payment and billing information.

By submitting payment details, you confirm that you are authorised to use the payment method and that the payment information you provide is accurate. You authorise us, Shopify and our payment providers to process payment for your order, including product costs, shipping charges, taxes and other amounts shown at checkout.

We do not store full card details on our own systems. Payments are processed through Shopify, payment providers and other secure third-party services.

8. Shipping and delivery

We will deliver your order to the delivery address you provide at checkout. You are responsible for ensuring your delivery details are accurate and complete.

Delivery timeframes shown on our website, in emails or at checkout are estimates only, unless we expressly state otherwise. Delays may occur due to carriers, customs processing, weather, public holidays, peak periods, incorrect address details, failed delivery attempts or other events outside our reasonable control.

For consumer orders, we remain responsible for delivery of your order until it is delivered to the address you provided, except to the extent a delivery issue is caused by incorrect delivery details, failure to collect, refusal of delivery, or circumstances outside our reasonable control.

If your order is delayed, damaged in transit, marked as delivered but not received, or appears to be lost, please contact us as soon as possible. We will work with the carrier and take reasonable steps to help resolve the issue.

International orders may be subject to customs checks and import processes. We are not responsible for delays caused by customs, border authorities or import clearance requirements.

9. Returns, refunds and exchanges

Your rights under our Refund Policy are in addition to any rights you may have under applicable consumer protection laws.

Please refer to our Refund Policy for details about change-of-mind returns, exchanges, faulty products, damaged products, incorrect items, return timeframes and return instructions.

Because some of our products are intimate, adhesive, reusable or skin-contact products, return eligibility may depend on whether the product is unused, unopened, hygienically safe to return, faulty, damaged, incorrect or otherwise covered by applicable law.

Nothing in our Refund Policy or these Terms limits your non-excludable consumer rights.

10. Product reviews, feedback and user content

If you submit, upload, post, email, tag us in, or otherwise provide reviews, comments, photos, videos, testimonials, ideas, suggestions or other content relating to our products, website or brand, you grant us a worldwide, royalty-free, transferable and sublicensable licence to use, reproduce, edit, publish, display, distribute and promote that content for our business purposes, including on our website, emails, social media, advertising and other marketing channels.

You confirm that:

• you own or have the necessary rights to provide the content;

• the content is truthful and not misleading;

• the content does not infringe anyone else’s rights;

• the content does not contain unlawful, offensive, defamatory, abusive, obscene or harmful material;

• the content does not contain malware, viruses or harmful code; and

• you have disclosed any incentive, discount, payment, gifted product or other benefit you received in connection with the content.

We may monitor, edit, refuse, remove or not publish user content at our discretion, including where we believe it may breach these Terms, be unlawful, be misleading, disclose personal information, infringe rights, or be inappropriate for our brand or audience.

You remain responsible for the content you provide.

11. Intellectual property

Our website, brand, trade marks, logos, product names, product descriptions, images, graphics, videos, reviews, layouts, designs, content and other materials are owned by or licensed to nip stories and are protected by New Zealand and international intellectual property laws.

You may use our website for personal, non-commercial shopping and browsing purposes only.

You must not copy, reproduce, scrape, extract, download, store, modify, distribute, republish, display, sell, resell or exploit any part of our website, content, products, branding or materials without our prior written consent, except to the extent permitted by law.

The name nip stories, our logos, product names, slogans, designs and related brand elements are trade marks or brand assets of RS STORIES LTD t/a nip stories. You must not use them without our prior written consent.

Shopify’s name, logo and related marks belong to Shopify. Other third-party names, logos and marks belong to their respective owners.

12. Third-party services, links and tools

Our website may include links to third-party websites, services, apps, tools, payment providers, shipping providers, social media platforms, embedded features or other third-party functionality.

We do not control third-party websites or services and are not responsible for their content, accuracy, availability, security, terms, privacy practices, products or services.

If you access or use a third-party website or service, you do so at your own risk and should review that third party’s terms and privacy policy.

13. Privacy

Our collection, use, storage and disclosure of personal information is described in our Privacy Policy.

Because our store is powered by Shopify, personal information may also be collected and processed by Shopify and by other third-party service providers who help us operate our website, process orders, take payments, provide shipping, send emails, provide analytics, run advertising or deliver customer support.

Some of these providers may be located outside New Zealand or may process information in other countries. Please read our Privacy Policy for more details about how personal information is handled, including overseas processing and your privacy rights.

14. Marketing communications

If you subscribe to our emails, SMS messages or other marketing communications, we may send you brand updates, product information, offers, reminders and other marketing content.

You can unsubscribe from marketing emails by using the unsubscribe link in the email. Transactional messages relating to your order, account, delivery, payment, support requests or legal notices may still be sent where necessary.

You must not use bots, scrapers, crawlers, automated tools, AI agents or similar technologies to access or interact with our website in a way that is unlawful, misleading, excessive, harmful, intended to bypass security, or intended to copy, extract or misuse our content, pricing, product data, reviews, customer information or other materials.

We may allow access by search engines, AI shopping tools, accessibility tools and other automated systems where they follow our technical instructions, identify themselves appropriately, and do not harm, overload, misrepresent or misuse our website or content.

We may use technical measures to block, limit or control automated access where we consider it necessary to protect our website, customers, business, intellectual property, systems or service providers.

Occasionally, information on our website or in communications may contain errors, inaccuracies or omissions, including in relation to product descriptions, images, pricing, discounts, promotions, shipping charges, delivery timeframes, availability or other details.

We may correct errors, inaccuracies or omissions, update information, cancel affected orders or contact you for instructions where appropriate. If we cancel an order due to an error after payment has been taken, we will refund the amount paid for the cancelled items.

We may update, suspend, withdraw, restrict or change any part of our website, content, features, tools or services at any time, including for maintenance, security, technical, business or legal reasons.

Nothing in this section limits any consumer guarantees, product safety obligations, rights or remedies that cannot lawfully be excluded.

20. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive loss or damage, or for loss of profit, revenue, business, savings, data, goodwill or opportunity, arising out of or in connection with your use of our website, services or products.

To the fullest extent permitted by law, our total liability to you for any claim relating to your use of our website, services or products is limited to the amount you paid us for the product or service giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability under applicable consumer protection laws.

21. Indemnity

You agree to indemnify us, our directors, employees, contractors, service providers and affiliates against losses, damages, liabilities, costs and expenses arising from:

This indemnity does not apply to the extent the loss, damage, liability, cost or expense is caused by our breach of these Terms, negligence, wilful misconduct, or a matter for which we cannot lawfully exclude responsibility.

We may suspend, restrict or terminate your access to our website, services or account if we reasonably believe you have breached these Terms, misused our website, created risk for us or others, or acted unlawfully.

You remain responsible for amounts due for orders placed before termination.

Sections that by their nature should continue after termination will continue to apply, including sections relating to consumer rights, intellectual property, user content, privacy, disclaimers, limitation of liability, indemnity, governing law and dispute resolution.

You may not transfer, assign or delegate your rights or obligations under these Terms without our prior written consent.

We may transfer, assign or delegate our rights and obligations under these Terms as part of a business sale, restructuring, merger, acquisition, transfer of assets, change of service provider, or by operation of law, provided this does not unlawfully reduce your consumer rights.

If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be read down or severed to the extent necessary, and the remaining parts will continue to apply.

If we do not exercise or enforce a right under these Terms, this does not mean we have waived that right. A waiver must be in writing to be effective.

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy and any other policies or terms referred to on our website, form the agreement between you and us in relation to your use of our website and purchases from us.

27. Governing law and disputes

These Terms are governed by the laws of New Zealand.

You and RS STORIES LTD t/a nip stories submit to the non-exclusive jurisdiction of the courts of New Zealand.

If you are located outside New Zealand, you may also have rights under consumer protection laws in your country or region that cannot lawfully be excluded.

If you have a concern or dispute, please contact us first so we can try to resolve it directly.

28. Changes to these Terms

We may update these Terms from time to time by posting the updated version on our website.

The updated Terms will apply from the date they are posted or from any later date stated in the updated Terms. Your continued use of our website or placing of orders after the updated Terms take effect means you accept the updated Terms.

If a change is material and we are required by law to notify you, we will do so in accordance with applicable law.
